I understand and agree that:
1. Acceptance of Terms
This Agreement sets forth legally binding terms for my participation in any of the Crystal Cuvée Burlesque online classes. By participating in the class, I agree to be bound by this Agreement. This Agreement may be modified from time to time, and such modification shall be effective upon its posting on the Website. I agree to be bound by any modification to this Agreement when I use the Website after any such modification is posted; it is therefore important that I review this Agreement regularly.
2. Acknowledgement of Risk
The online dance tutorials and lessons provided by Crystal Cuvée Burlesque and any and all instructors on the videos are for educational and entertainment purposes only. Dancing is not without its risks, and this, or any other dance tutorials and lessons, may result in injury. Such possible injuries include but are not limited to: risk of new injury, aggravation of a pre-existing condition, or adverse effect of over-exertion such as muscle strain, abnormal blood pressure, fainting, disorders of heartbeat, and other mental or physical issues not mentioned here.
3. Statement of Health
To reduce the risk of injury, before beginning this or any dance tutorials or lessons, I am advised to consult a healthcare provider for appropriate safety precautions and clearance to participate in this, or any of the other Crystal Cuvée Burlesque classes. I therefore represent and warrant that I am physically fit and have no medical or psychiatric condition that would prevent me from participating in this class. As with any dance program, if at any point during the lessons I begin to feel faint, dizzy, or have physical discomfort, I should stop immediately and consult a physician.
4. Waiver of Liability
Crystal Cuvée Burlesque is not a medical organization and its instructors or staff cannot give me medical advice or diagnosis. All suggestions and comments relating to poses, moves and instruction are not required to be performed by me and are carried out at my election while viewing the Crystal Cuvée Burlesque course videos. Nothing contained in this Website should be construed as any form of such medical advice or diagnosis.
By using the Website I represent that I understand that physical exercise involves strenuous physical movement, and that such activity carries the risk of injury whether physical or mental. I understand that it is my responsibility to judge my physical and mental capabilities for such activities. It is my responsibility to ensure that by participating in classes and activities from Crystal Cuvée Burlesque, I will not exceed my limitations while performing such activity, and I will select the appropriate duration and classes for my skills and abilities, as well as for any mental or physical conditions and/or limitations I have.
I understand that, from time to time instructors may suggest physical adjustments, modifications or the use of equipment that is appropriate for my level of ability and physical and mental condition and it is my choice whether or not to use those suggestions. I expressly waive and release any claim that I may have at any time for injury of any kind against Crystal Cuvée Burlesque or any person or entity involved with Crystal Cuvée Burlesque including without limitation its directors, principals, instructors, independent contractors, affiliates and representatives, now or in the future.
4. Minors
Crystal Cuvée Burlesque’s content is not directed to persons under eighteen (18) years of age, and by providing information about myself to Crystal Cuvée Burlesque I am representing that I am eighteen (18) years of age or older.
5. Proprietary Rights
I understand that recording of the Crystal Cuvée Burlesque Online Dance Lessons is strictly prohibited. I agree to not reproduce, sell, share or distribute any recordings of the Crystal Cuvée Burlesque Online Dance Lessons. I understand that music used in the videos is not property of Crystal Cuvée Burlesque and is for educational purposes only. Signing up for Crystal Cuvée Burlesque Online Dance Lessons does not grant me a license or permission to use third party copyright materials including music.
6. Indemnity
I agree to defend, indemnify and hold harmless Crystal Cuvée Burlesque, its subsidiaries, affiliates, subcontractors, officers, directors, employees, consultants, representatives and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys’ fees and costs) arising from: (i) my use of and access to the Website; (ii) my violation of any term of this Agreement; (iii) my violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of my submissions of Content caused damage to a third party. This defense and indemnification obligation will survive this Agreement and my use of the Website.
7. General Registration Requirements
If I wish to participate in Crystal Cuvée Burlesque classes, I must read this Agreement before buying a course or otherwise accessing the course. My accessing or buying the course will serve as confirmation that I have read and agree to all of this documents stated terms and conditions including the waiver of liability. In consideration of my use of the Website, I represent that I am of legal age to form a binding contract and am not a person barred from receiving services under the laws of the United States or other applicable jurisdiction.
8. My Acknowledgement of all terms and liability waiver
By purchasing or otherwise accessing a Crystal Cuvée Burlesque course I am legally stating that I have read the above Release and Waiver of Liability and fully understand and agree to its contents.
